When using the e-shop, the products declared here, it is necessary for the customer to familiarize themselves in detail with their content, instructions and recommendations, which are part of each offered product.   1. The price of delivery for delivery to the agreed place shall be added to the price of the order. The transport price is charged to the customer according to the respective transport price list.
  2. The seller is a VAT payer.
  3. The place of delivery is in the Slovak Republic.
  4. Goods can be purchased only as a whole package, it is not possible to divide, weigh or repackage individual packages.
  5. For orders over 35 EUR, if the place of delivery is in Slovakia, free shipping.
  6. The method of payment is cash on delivery. By mutual agreement it is possible to use another method of payment for goods.
  7. Prices of the goods are continuously updated, therefore the supplier reserves the right to change the current prices for reasons such as: beginning or end of the event, advance sale, special discounts, change in the purchase price, etc.

Ordering goods

Orders of goods from the e-shop are accepted after confirmation of the order, acceptance of business and transport conditions.

You can cancel or change your order by email to sales@divine-spices.com and always include the order number. If the seller does not receive an order cancellation or change within 8 hours of its confirmation, the order is considered binding. In this case, the order will not be canceled or changed and the customer is obliged to take over the ordered shipment and pay for it.

The buyer may cancel or change the order even if the seller informs him that the goods are not available or in the required quantity.

The Seller may cancel or change the order if it is not possible to fill the contents of the order due to the unavailability of the ordered goods by the supplier at all or in the required quantity. The seller may also cancel the order if the buyer has provided incomplete or false information in the order form. In this case, the seller informs the buyer about the change or cancellation of the order by sending an email or by telephone.

By confirming the order, the buyer declares that he has chosen the object of purchase himself and is ready to pay it. By confirming the order, the Buyer declares that he / she has reached the age of at least 18 years, while the Seller may require the Buyer to prove the Buyer's identification card proving the required age at the time of delivery. The subject matter of the purchase becomes the property of the buyer only after payment of the purchase price.

Delivery of the subject of purchase

The Seller undertakes to deliver the required item of purchase according to the availability of the goods in the required quantity, content, quality and within the time period specified, which confirms the Buyer in the confirmation of the order sent by e-mail.

The Seller is obliged to ensure the transport of the subject of purchase to the Customer in accordance with the Order. The price for the delivery of goods is part of the purchase price and the buyer is familiar with the price in the order form and at the same time confirms the order with the price for delivery of the subject of purchase.

In the case of obvious damage to the shipment, the buyer is obliged not to take it from the carrier and immediately inform the seller of this fact. Upon notification of non-receipt of the shipment by the Buyer, the Seller shall send the Buyer a new shipment in accordance with the original order upon his request.

A. UPS Courier delivery takes 1 business day.

B. Delivery by Slovak Post takes 3 working days. In case of transport by the Slovak Post we are not responsible for delays of transport and any situations when the postal worker does not announce the arrival of the shipment. If the package is smaller than 1kg and the postman will not reach you at home, he will leave a “yellow ticket” in the box. For larger packages over 1 kg, you will have the package stored in the post office and will be notified by mail or SMS as soon as your package arrives. If you do not receive the notification within 5 business days of the date of your order, please call us at 0948/050749, we will be happy to assist you.

Disclaimer

The Seller is not liable for damage to the subject of the purchase and its incompleteness as well as for delayed delivery caused by the carrier. The Seller shall not be liable for non-delivery of goods if the Customer stated incorrect delivery address, telephone number or is not reachable.

Complaints

The buyer has the right to file a complaint if the content, quality, price and completeness of the shipment does not correspond to the confirmed order.

The seller receives complaints every working day by e-mail to sales@divine-spices.com. To make a claim for quality and content, it is necessary to send the subject of the claim in the original packaging and quantity to the address of the seller's registered office.

In the case of a complaint about the quality and content of the subject of the purchase, the complaint procedure will start only after receiving the claimed subject.
The buyer is obliged to handle the complaint no later than 30 days from the beginning of the complaint procedure and inform the buyer about the result of the complaint procedure either by email or by telephone. In the event of a justified claim, the Seller shall supply the Buyer with new goods or refund the amount of the price according to the original order.

Goods reclaim

The Buyer may return the ordered item to the Seller without giving a reason within 7 calendar days of its payment. In this case, it is necessary that the purchase item is returned complete in the undamaged and original packaging and quantity in accordance with the originally delivered order. The buyer is obliged to inform about the interest of returning the subject of purchase to the seller in advance by e-mail to sales@divine-spices.com

In this case, the buyer bears the costs of return delivery from the buyer to the seller. After receiving the shipment from the buyer and checking its contents, the seller pays the price of the subject of purchase without the cost of delivery back to the buyer pursuant to the previous agreement, either to a bank account or by postal order within 3 working days of receipt of the subject of purchase.

Consignments returned because they are not accepted by the consumer will not be sent back to the consumer. In this case, the purchase contract is canceled. If the consumer himself expresses his interest in returning the returned goods, the seller has the right to demand from the consumer also the cost of returning and returning the shipment.

Warranty period

For goods sold in the online store www.chute.sk unless otherwise stated on the packaging of the subject of purchase, the warranty period in accordance with applicable laws applies.

Final provisions

Relations that are not regulated by these Terms and Conditions are governed by the relevant laws in force in the territory of the Slovak Republic. By confirming the order, the buyer also confirms that he is familiar with the business conditions of the seller, agrees with them and accepts them. The seller reserves the right to change the business conditions, content and prices of goods. These terms and conditions are valid from 31.12.2016.

Data protection

The contracting parties have agreed that the Buyer, if he is a natural person, is obliged to inform the Seller of his name and surname, permanent address including postcode, delivery address including postcode, telephone number and e-mail address.

The contracting parties have agreed that the Buyer, if it is a legal entity, is obliged to notify the Seller of its business name, address, including zip code, address of delivery of goods including zip code, VAT number, VAT number, telephone number, e-mail address, name and the surname of the contact person.
The Seller shall use the Buyer's data only for the purpose of identification of the Buyer, for the execution of trade and payment, distribution of goods, further in communication with the Buyer, preparation of a tax document.

By submitting the data, the user expresses his / her consent to the processing of personal data according to Act no. On the protection of personal data in information systems. The online store operator undertakes that personal information provided by the buyer through registration and order form will not be provided without the consent of the owner of this data to third parties and will not be used for a commercial offer unrelated to the promotion of this online store. At the same time, it undertakes to delete its personal data from its customer database at any time at the customer's request.

Final provisions:

All legal relations between the buyer and seller are governed by the laws of the Slovak Republic. In matters not regulated by these Terms and Conditions, the relevant provisions of the Commercial Code shall apply. The operator reserves the right to change these terms and conditions. These business conditions come into effect on 31.12.2016.
